Commonwealth v. Evans: Drug Distribution DISMISSED

May 2015

Client was arrested in his car on suspicion of prior narcotics dealings. The vehicle, including all of the personal property inside, was seized. The Commonwealth charged felony possession with intent to distribute cocaine, and misdemeanor possession of marijuana. After aggressive and tenacious investigation and challenges to the government evidence, the felony had to be dismissed for constitutional violations, and the vehicle was released to its owner, along with the property seized inside. The client did plead guilty to the misdemeanor possession of marijuana charge, but will not have ANY probation, and no uniform good behavior requirement.
